Erlanger Medical Center Unable to Halt Government’s Fraud Claim

A Tennessee medical system and others must continue to defend against a False Claims Act suit alleging they improperly received Medicare reimbursement payments.

The government adequately alleged Erlanger Medical Center and Erlanger Health System had several financial relationships with doctors it employed that violated the Stark Law, and that it billed Medicare for procedures referred by doctors with whom Erlanger had those relationships, Judge Curtis L. Collier of the US District Court for the Eastern District of Tennessee said in a Thursday order denying a motion to dismiss.
