Fresenius Director Can Advance False Claims Retaliation Suit

A former Fresenius Management Services Inc. director can continue his suit alleging that the company violated the False Claims Act’s anti-retaliation provision by firing him for calling attention to a dialysis services kickback scheme, a Tennessee federal district court said.

Ryan Rowe adequately alleged that he engaged in protected activity under the FCA by stating that he attempted to stop Fresenius from charging medical providers below fair market value for dialysis and related services in order to induce patient referrals, including Medicare beneficiaries, Judge Thomas A.
