Punishments in West Coast Marijuana Scheme Need Another Look

A Texas federal court must reconsider punishments for two men convicted for partaking in a scheme to unlawfully peddle in other states marijuana legally purchased in California and Oregon.

Ronald McGuire showed that the lower court erred in calculating the quantity of drugs he transported, and should get a chance to argue for a lesser sentence. His co-defendant, Eric Roberts, demonstrated that his punishment for a gun charge was improper, Judge Dana M. Douglas of the US Court of Appeal for the Fifth Circuit said in an Aug. 29 opinion.
