Kentucky Tobacco Farm Gets DOL Reprieve Over Visa Enforcement

A Kentucky tobacco won’t face a Department of Labor administrative process over alleged violations of a work visa program until the US Supreme Court weighs in on the agency’s enforcement authority.

Triple R Farms, which is facing $70,000 in penalties connected to the H-2A program, sued the agency to block an in-house judge from adjudicating the alleged violations involving wages, record keeping, and housing. Owners of Triple R argued they’re entitled to a trial in an Article III federal court.
