Arizona, Abortion Advocates End Suit Over ‘Reason’ Abortion Ban

A lawsuit challenging Arizona’s law banning abortions when a fetus tests positive for a genetic anomaly ended after a federal judge granted the parties’ stipulation of dismissal.

Judge Douglas L. Rayes dismissed the case Tuesday, saying there didn’t appear to be good cause to keep it open. The US District Court for the District of Arizona judge also dissolved as moot an order blocking enforcement of a provision intended to help doctors decide if a fetus has a genetic anomaly.

The dismissal order was without prejudice—meaning the case could be refiled.
