Florida Medicaid Termination Notices Ruled Inadequate (1)

Florida must provide more detailed Medicaid termination notices after a federal judge ruled the state’s current forms are unlawfully ambiguous.

Judge Marcia Morales Howard of the US District Court for the Middle District of Florida ruled Tuesday in favor of a class of Medicaid recipients who claimed that the state’s benefit termination notices violated their due process rights and resulted in the loss of their health-care coverage.

Howard found that Florida’s notices violated beneficiaries’ due process rights under the Constitution. Howard ordered the state to include more specific information about income calculations and eligibility standards in future notices.
