A small grocery chain can keep its attorneys’ fee award after it dismissed a surveillance technology company’s patent infringement claims, the Federal Circuit said.
The district court didn’t abuse its discretion in awarding attorney’s fees to Castle Retail LLC under 35 U.S.C. § 285 — a statute that permits the award of fees to a prevailing party in cases deemed exceptional, including for their frivolity or unreasonableness, the US Court of Appeals for the Federal Circuit said Friday in a nonprecedential opinion.
