Hawaii Resists Effort by Top PBMs to Toss Drug Pricing Lawsuit

The US’s leading pharmacy benefit managers lost an attempt to toss Hawaii’s lawsuit accusing them of unfair pricing practices as the companies increasingly come under the microscope of cities, states, and federal regulators.

Judge Leslie E. Kobayashi of the US District Court for the District of Hawaii issued an order Friday denying a motion to dismiss filed by CVS Health Corps’ Caremark, UnitedHealth Group Inc.’s OptumRx, and Cigna Group’s Express Scripts while the judge considers Hawaii’s motion to remand the case to state court.
