Maryland Justices Signal Support for Potomac Edison’s Tax Refund

A FirstEnergy Corp. unit appears poised to keep its $2.42 million sales and use tax refund after Maryland Supreme Court justices pushed hard during oral arguments Wednesday against the state’s reasons for denying an exemption.

The Maryland comptroller’s office wants the justices to overturn a state appeals court ruling that Potomac Edison Co.'s equipment is covered by the state’s tax exemption for production activity. That equipment is used not to generate electricity, but to transmit and deliver it, the state told the high court.
