Nebraska Medical Providers Not Liable for Covid-19 Related Care

A federal public health emergency law shielded Nebraska health-care providers from suit and liability for pressure ulcers developed by a patient while on a ventilator during treatment for Covid-19, a state appeals court said.

Regional West Physicians Clinic and Regional West Medical Center were properly granted summary judgment in a suit filed by patient Terry Reitz for injuries associated with his care, the Nebraska Court of Appeals said Tuesday in an unpublished opinion. The federal Public Readiness and Emergency Preparedness Act’s immunity provision barred the lawsuit, Judge Michael W. Pirtle said for the court.
