A North Dakota law prohibiting the use of puberty blocking drugs and cross-sex hormones to treat gender dysphoria in minors doesn’t violate the state’s constitution, a trial judge said.
The gender-affirming care ban for minors doesn’t discriminate based on sex, wasn’t shown to have been motivated by anti-transgender animus, and trans status isn’t a suspect classification justifying heightened scrutiny under the North Dakota Constitution, the North Dakota District Court, Burleigh County, said Wednesday.
The provision was reasonably related to legitimate state interests and doesn’t violate the state constitution’s equal protection guarantee, Judge Jackson J. Lofgren said.
