Ornua Foods North America Inc. failed to convince a federal court that a class action alleging that its Kerrygold Butter products contain PFAS should be dismissed on the pleadings.
Plaintiff Carolyn Winans sufficiently alleged that PFAS—an artificial chemical linked to cancer—migrated from the packaging to the butter, as she cited several studies establishing that possibility, Judge Frederick Block of the US District Court for the Eastern District of New York said Tuesday. Winans’ theory “strikes the Court as plausible,” Block said.
