The US Supreme Court on Tuesday granted review and vacated a lower court’s decision in a case that raised questions over agency discretion in administering grant programs created by Congress.
The US Health and Human Services Administration mooted the suit in 2025 when it restored an award to Tennessee it had previously clawed back when the state refused to comply with a condition of participation in a federal family planning grant program.
