A divided Sixth Circuit panel on Friday blocked federal guidance documents intended to protect gay and transgender students’ access to bathrooms and sports teams from being enforced in 20 states, saying the Biden administration didn’t follow proper procedure before adopting them.
The ruling from the U.S. Court of Appeals for the Sixth Circuit comes the same week as courts in the South came to similar conclusions for a rule the administration created for Title IX, resulting in its position on certain LGBTQ+ rights in schools being unenforceable in a large swath of the country.
