A Sentara Health senior software engineer lacks evidence he was fired based on his ADHD and obsessive-compulsive disorder or because he was 57 years old, a Virginia federal judge ruled.
The healthcare company showed it terminated Daniel Berger for lying about why he used a specific technical architecture on a particular project, telling his supervisor he’d done so at the direction of her boss, the US District Court for the Eastern District of Virginia said. Berger failed to rebut that explanation as pretextual because he didn’t raise a dispute on whether his supervisor really believed he’d been dishonest.
