A California federal district court denied MarketSource, Inc. employees’ renewed motion for class certification in a wage and hour putative class action, finding that one of the employees employed as a team lead with supervisory responsibilities had a conflict of interest that rendered him an inadequate class representative under federal law, as he was involved in implementing at least one of the challenged policies regarding rest breaks that the class sought to challenge.
