ACA-Exempt Health-Care Ministry Fails to Revive New Mexico Suit

A Christian health-care cost-sharing group lost its appeal from the dismissal of a lawsuit claiming New Mexico’s insurance commission is unlawfully trying to drive it out of business.

Samaritan Ministries International and its members don’t have standing to sue Insurance Superintendent Alice Kane to prevent her from taking administrative actions against them because there’s no proof she’d threatened to do so, the US Court of Appeals for the Tenth Circuit said Thursday in an unpublished opinion.
