CVS Health Corp. is entitled to insurance coverage for litigation alleging it fueled the opioid crisis, despite a landmark 2022 decision siding with insurers over Rite Aid Corp. on opioid-related litigation, CVS told the Delaware Supreme Court.
The CVS case is distinct from Rite Aid’s, in part because CVS’ insurance policies afforded broader coverage under pharmacist liability provisions, the Rhode Island-based retail pharmacy giant said during oral arguments Wednesday.
CVS’ insurers, on the other hand—including units of Chubb Ltd. and American International Group Inc.—said both cases involved national pharmacies facing similar litigation and that the same result should apply. ...
