Liberty Mutual, Magnet Maker Agree on Venue for Pollution Fight

Liberty Mutual Insurance Co. will litigate a pollution coverage dispute with a magnet maker in Massachusetts federal court instead of Pennsylvania, where the insurer first filed suit.

The Boston-based insurer and Arnold Engineering Co. have agreed Massachusetts is the proper venue, according to a joint stipulation of dismissal without prejudice filed Tuesday in the US District Court for the Western District of Pennsylvania. Arnold had argued it lacked sufficient ties to Pennsylvania for that court to exercise personal jurisdiction.
