A Texas-based stone slab distributor is facing a lawsuit from its liability insurer over coverage for litigation brought by the family of a fabrication worker who allegedly died as a result of exposure to silica contained in stone products.
A silica exclusion barred coverage for the California state court suit under the commercial general liability insurance policy issued to Verona Marble Co., EMCASCO Insurance Co. said in a complaint filed Tuesday in the US District Court for the Northern District of Texas.
The filing adds to a pileup of coverage disputes over stoneworker claims.
