BMW Anti-Suit Injunction Not Blocked by Appeals Court, for Now

The Federal Circuit declined a patent owner’s emergency bid to stop a Texas federal judge’s order from taking effect and ending a German lawsuit accusing BMW of infringing two US patents.

Onesta IP LLC, which acquired the chip patents from Advanced Micro Devices Inc., filed an emergency motion on Wednesday asking the appeals court to block the district court’s anti-suit injunction, which it said threatened its first-of-its-kind assertion of US patents in a German court.
