The District of Utah denied Flashpoint Energy Partners LLC and a former employee summary judgment on Kiva United Energy’s trade secret misappropriation and breach of contract action. According to the court, Kiva sufficiently identified its claimed trade secrets, and questions of fact exist as to whether the employee used the type of information that would qualify as a trade secret to solicit new customers, whether Kiva adequately protected that information, and whether that information was known outside of the business.
