A federal district court in California denied Air Horns of Texas LLC and Texas Air Horns LLC’s motion for summary judgment on Grover Products LLC’s action for trademark counterfeiting, trademark infringement, breach of contract, false designation of origin, false and misleading descriptions and representations of fact, and false advertising. The court determined that Grover Products provided competent evidence for its trademark infringement, false designation or origin, and counterfeiting claims, and a genuine issue of material fact exists as to abandonment.
