Judge Rejects Biogy’s Bid to End Okta, Microsoft Patent Cases

Biogy Inc. failed to convince a federal judge to dismiss Okta Inc. and Microsoft Corp.'s lawsuits seeking declarations that their products didn’t infringe the cybersecurity firm’s patent for password protection systems.

Okta and Microsoft have standing to file declaratory judgment lawsuits because Biogy accused the companies of infringement by writing letters to their customers identifying Okta and Microsoft source code as evidence of infringement, according to two orders filed Monday in the US District Court for the Northern District of California.

That creates an actual controversy, giving the court jurisdiction, Judge Araceli Martinez-Olguin said.
