Magnolia Medical Technologies Inc.’s failed to invalidate competitor Kurin Inc.’s patent in a lengthy blood culture collection kit dispute.
Judge Colm F. Connolly ruled Tuesday there is a factual dispute about whether prior art exists for Kurin’s US Patent No. 12,138,052, according to an order filed in the US District Court for the District of Delaware. Magnolia argued in July that it publicly disclosed the invention years before its competitor, stating the patent claims “repackage Magnolia’s prior art.”
