The Federal Circuit revived a patent dispute against Microsoft Corp.'s cloud platform Azure by reversing the tech giant’s summary judgment win while reversing a Texas federal judge’s decision to exclude opposing damages testimony.
The lower court incorrectly found that the opinion of Exafer Ltd.’s damages expert was unreliable, according to an opinion issued Friday in the US Court of Appeals for the Federal Circuit. Chief Judge Kimberly Moore reversed the district court’s decision and vacated Microsoft’s summary judgment win.
