Newman Urges Appeals Court to End Her Federal Circuit Suspension

Pauline Newman, the nation’s oldest active federal judge, reiterated her argument the DC Circuit should revive the lawsuit challenging as unconstitutional her suspension from hearing cases at the Federal Circuit.

The 97-year-old judge has previously argued on appeal that her benching was effectively a removal from her duties at the US Court of Appeals for the Federal Circuit without constitutionally required impeachment proceedings. In a new filing Monday, she said her colleagues’ recent counterarguments demonstrate that’s she’s been removed as they “make clear that Judge Newman’s suspension is unlikely to ever be lifted.”
