Nintendo Must Defend Additional Counts in Gamevice Patent Suit

Nintendo Co. will face five patent infringement claims previously dismissed in a suit by hardware rival Gamevice Inc.over the hand-held Nintendo Switch gaming console, a federal trial court said.

A March 14 order dismissing all but one of Gamevice’s claims “did not follow the proper mode of analysis under federal patent law,” Judge Richard G. Seeborg of the US District Court for the Northern District of California said Wednesday, granting a motion for reconsideration.

The proper analysis would have been to assess each of the relevant claims individually, rather than by analyzing each category of claims individually, Seeborg said. ...
