The National Labor Relations Board is seeking to prevent Cemex Construction Materials LLC from trying to delay mandatory bargaining with a union by challenging part of a board order that would have no practical effect.
The NLRB on Thursday asked the US Court of Appeals to for the Ninth Circuit to nix language from a recent ruling that—in addition to enforcing a bargaining order—would also back a Thryv, Inc. remedy for Cemex to pay a worker for downstream economic consequences of his illegal termination.
