Owner of ‘open.ai’ Domain Appeals Trademark Suit Loss to OpenAI

Open Artificial Intelligence Inc. is appealing the cancellation of its supplemental “Open AI” trademark registration and OpenAI Inc.‘s infringement win to the Ninth Circuit.

OAI will challenge a finding that its founder, Guy Ravine, intended to deceive the US Patent and Trademark Office to secure its registration. Ravine and OAI, who filed a notice of appeal Aug. 29, submitted usage samples that didn’t exist when OAI applied and expanded into OpenAI’s market after ChatGPT launched, the US District Court for the Northern District of California said.
