Samsung Tells Judges Netlist Memory-Patent Verdict Is Skewed (1)

Samsung Electronics Co. urged the Federal Circuit to wipe out a $303 million jury verdict in a memory-chip patent lawsuit because it rests on an unprecedented, flawed approach to measuring damages.

Specifically, the South Korean semiconductor giant told a panel of judges that patent owner Netlist Inc.'s expert incorrectly told East Texas jurors Samsung should pay all of its incremental revenue—rather than just its profits—from a product that included technology captured in five Netlist’s patents.
