Walmart Fails in Bid to Nix Website Patent Infringement Suit

Walmart Inc. must continue to defend against Adaptive Avenue Associates Inc.'s lawsuit alleging the retailer infringed patents involving a system formaking website presentations, and a system to help navigate through a plurality of sites.

Walmart didn’t show that this early stage of the case Adaptive Avenue’s claims are ineligible as a matter of law, Judge David Counts of the US District Court for the Western District of Texas said in a Thursday opinion. Counts adopted Magistrate Judge Derek T. Gilliland’s Feb. 6 report and recommendation.
