Arbitrator Lee Hornberger ruled that Lincoln County, Oregon didn’t violate the CBA when the county refused to allow the grievant, a laid off detective, to bump into a digital forensic analyst position following his layoff, because he wasn’t selected by anyone with Article 16.3 authority to fill the vacancy. The responsibility to determine the qualifications of a bumping employee is exclusive to the elected official in charge of the office in question, Arbitrator Hornberger found.
