The US Supreme Court agreed to clarify whether federal courts that exercise initial authority to adjudicate a case they stayed for arbitration retain the power to confirm or vacate the resulting arbitration award.
The justices on Friday granted Adrian Jules’ petition to examine a US Court of Appeals for the Second Circuit’s order to enforce an arbitrator’s dismissal of employment discrimination claims against hotelier André Balazs, in addition to sanctions imposed on Jules and his attorney for “beyond unusual” litigation misconduct.
