Federal appeals court judges expressed doubt Monday that the Trump administration properly installed John Sarcone as the top prosecutor in Albany as he directed investigations into New York Attorney General Letitia James.
The three-judge panel of the US Court of Appeals for the Second Circuit questioned Justice Department attorney Henry Whitaker on whether the attorney general’s designation of Sarcone as first assistant US attorney to keep him on as the lead prosecutor after his interim term expired improperly seeks to bypass the Senate confirmation process.
