Alito Concerned Judges ‘Tempted’ to Avoid Parent Rights Dispute

The US Supreme Court passed on reviewing a challenge to a Colorado school district practice said to discourage disclosure to parents of student gender identity although three conservative justices raised concerns that courts may be avoiding the issue.

In deciding against hearing the case, the court on Monday let stand the dismissal of a lawsuit against Poudre School District R-1. Families alleged the policy violated their due-process rights by interfering with their decision-making as parents.

Justices Samuel Alito wrote separately to concur with the cert denial, and was joined by Justices Clarence Thomas and Neil Gorsuch.
