Colorado’s antidiscrimination law providing protections for transgender and nonbinary individuals will remain enforceable while it faces a constitutional challenge.
The plaintiffs failed to show a “reasonable basis to infer they face a credible threat of prosecution” since their intended conduct—to refer to individuals using pronouns and names consistent with their sex assigned at birth—isn’t a violation of the challenged provisions, US District Court for the District of Colorado Judge Regina M. Rodriguez said Tuesday. Her order adopted a magistrate’s recommendation to deny a preliminary injunction.
