Illinois unlawfully provides in-state tuition rates and other financial aid to noncitizens who aren’t legally in the US while denying those benefits to citizens who aren’t Illinois residents, the US Department of Justice said Tuesday in a new lawsuit.
Federal law “explicitly overrides state resident tuition benefits” for noncitizens not lawfully present in the US unless it’s also available to citizens who reside outside the state, the federal government alleged in a complaint filed in the US District Court for the Southern District of Illinois.
Tuesday’s complaint is the latest of several Trump administration challenges to similar state laws. ...
