Judge Certifies Class of Detained Migrants Denied Bond Hearings

The Department of Homeland Security must give a newly certified class of thousands of immigrant detainees the opportunity to be considered for release on bond, a federal judge in California said.

Judge Sunshine Sykes on Tuesday expanded her Nov. 20 summary judgment order to cover all noncitizens who live in the US and haven’t been inspected by immigration officers, or arrested on grounds that would prompt mandatory detention. Her prior ruling, which applied only to the cases’ petitioners, said a July policy which required all arrested immigrants to be detained without the opportunity for bond hearings is unlawful.
