NY Judge Stuck With Harassment Loss, Secretary Gets Lawyer Fees

A former New York Family Court judge failed to convince a federal court to reject a sexual harassment verdict his secretary obtained against him.

Richard Miller didn’t show the jury that heard Rachelle Gallagher’s equal protection-based hostile work environment allegations that she lacked an evidentiary basis to hold him liable, the US District Court for the Northern District of New York said. The court rejected arguments by Miller—whom Gallagher worked for at Broome County court in Binghamton, NY—that he wasn’t shown to have acted under color of state law and that Gallagher didn’t prove the harassment was severe or pervasive. ...
