New York Attorney General Letitia James (D) won the right to enforce a state law requiring retailers to tell customers that they use algorithmic pricing—a blow to retail stores.
“Plaintiff’s members are free to utilize algorithmic pricing or not and are free to communicate their own views about the use of such technologies,” said Judge Jed Rakoff of the US District Court for the Southern District of New York, granting James’ motion to dismiss.
