OnlyFans Must Defend Against False Ad Class Action in California

Fenix International Ltd., the company that operates OnlyFans, failed to convince a federal judge to dismiss a proposed class action in California under a forum selection clause in the platform’s terms of service.

The “broad scope” of the provision covers the plaintiffs’ claims, but “enforcing the forum selection clause in favor of English or Welsh courts would ‘substantially diminish’ the rights of California residents to bring class action suits,” Judge Fred W. Slaughter of the US District Court for the Central District of California wrote in a Wednesday opinion.
