Prime Physicians Denied Chance to Protest Staffing Order Change

Prime Physicians PLLC is precluded from protesting the Indian Health Service’s corrective action rescinding its hospital staffing task order because the US Court of Federal Claims lacks jurisdiction to review the challenge.

After Prime Physicians received a task order to provide staffing at the Pine Ridge Hospital Emergency Department in South Dakota, Tribal Health LLC protested at the Government Accountability Office. The IHS acknowledged procurement “errors” and chose to undertake corrective action that included terminating the task order, accepting new proposals, and making a new award decision.
