“Road House” screenwriter David Lee Henry agreed to drop his appeal over the denial of his bid to strike Metro-Goldwyn-Mayer Studios Inc.'s breach of contract counterclaims in a copyright dispute.
Henry and MGM filed a joint stipulation to dismiss the appeal last week, after a recent US Court of Appeals for the Ninth Circuit ruling held a district court’s denial of an anti-SLAPP motion to strike isn’t immediately appealable, reversing its 22-year holding in Batzel v. Smith. The Ninth Circuit dismissed Henry’s appeal in an order entered Wednesday.
