Spirit Airlines violated federal law when it retained security fees from travelers who canceled their flights instead of giving the money to the Transportation Security Administration, a federal appeals court ruled.
The administration has statutory authority to collect security fees even when a customer doesn’t travel or when Spirit refunds the fee through travel credits, the US Court of Appeals for the Eleventh Circuit said in a Monday opinion rejecting the airline’s petition for review.
