A Texas judge who refuses to marry same-sex couples for religious reasons can seek damages from a state commission that sanctioned another judge for doing so, the US Court of Appeals for the Fifth Circuit ruled Tuesday.
Jack County Judge Brian Keith Umphress is allowed to move forward with his claims at the district court, the appeals court said, rejecting an argument that the case is moot from the State Commission on Judicial Conduct.
