Texas can’t require warning labels on food or drinks containing one of 44 ingredients, a federal judge ruled Wednesday, saying that it likely violates the First Amendment.
Although the state law supports the state’s interest in supporting the health of Texas residents, “the means chosen to advance that interest do not pass constitutional muster,” the US District Court for the Western District of Texas said in an order granting a preliminary injunction to the industry groups challenging the statute.
