Antitrust Suit Against Elsevier, Academic Publishers Dismissed

Elsevier BV and other publishers escaped an antitrust lawsuit on Friday after a district court ruled the scholars and scientists suing failed to establish personal jurisdiction.

The plaintiffs also didn’t plausibly allege direct evidence of an antitrust conspiracy against any of the defendants, Judge Hector Gonzalez said. The US District Court for the Eastern District of New York granted the publishers’ motions to dismiss.

“In order for the court to accept Plaintiff’s characterizations it would have to read both in between the lines and outside the four corners of the document,” Gonzalez said.
