Insurance provider EmblemHealth and a group of its grievance and appeals specialists are seeking a judge’s final approval for a $3.8 million deal resolving the workers’ unpaid overtime claims.
Lead plaintiffs Dasya Cordova and Ada Casasus sought to certify a wage class action and collective with an April 2022 suit, alleging EmblemHealth Inc. and EmblemHealth Services Co. LLC violated the Fair Labor Standards Act and New York labor law by misclassifying its grievance and appeals specialists and similar specialists at a senior level as exempt from overtime pay between April 2016 and August 2025.
