Utah Modifies Garnishment Administrative Fee Collection

Utah administrative fees for creditor garnishments will be collected by employers from the amount payable to the creditor, under a bill effective May 6.

Current state law requires a creditor to pay a one-time fee to the employer when the writ of garnishment is served. The fee amount is $10 for a single garnishment and $25 for continuing garnishments.

SB 307 maintains these amounts but instead requires employers to collect the fee from the garnished wages.

Employers must notify creditors if the amount to be sent does not exceed the fee amount, under the bill.
